Understanding Class Action Lawsuits

Class actions are civil lawsuits in which one or more plaintiffs sue a party (or parties) on behalf of a larger group, called a class, that has suffered similar harm resulting from the defendant’s actions or inaction—with settlement or judgment proceeds shared among class members. Class Actions and Class Representatives

In class action proceedings, the court appoints a lead plaintiff whose case is typical of the class to serve as their representative throughout litigation. The class representative’s name appears as the plaintiff in the lawsuit, and they work closely with the attorneys and other plaintiffs to make decisions about the case until it’s resolved.

Class Action Certification Requirements 

Class action litigation can only move forward if the class meets the prerequisites for court certification. Though certification criteria can vary by state, many states follow Rule 23 of the Federal Rules of Civil Court Procedure, which requires that:

  • The number of potential claimants is so numerous that joining them all in a single lawsuit would be impractical;
  • The claims share common questions of law or fact, meaning that class members share somewhat similar claims;
  • The lead plaintiffs’ cases are the same as others in the class, and defenses to those claims are likely to be similar; and 
  • The class representatives and the lawyers handling the case must be capable of fairly and adequately representing the class's interests.
